BRONX, NEW YORK, JULY 2- Let’s recap this past session which came to an end on Friday June 26^th. 

There were several major items that had to be taken care of: Rent Regulations that had expires in mid June, The 421A Tax Abatement program, Mayoral Control of the NYC public school system, and some other legislation such as judicial reform, Mayor de Blasio's 3 MTA Board appointments (to be confirmed by the State Senate), and anything else that was not done due to the Dysfunction in the state legislature.

Taking rent regulations first, which was Assembly Speaker Carl Heastie's major item that he was concerned about, let's see how he did. Well rent regulations will be in effect for at least four more years, but the apartment vacancy decontrol level was raised from $2,500 to only $2,700, and not the $3,000 level that many NYC assembly members had wanted it to be increased to. New tenant protections, there were none announced other than the 2 mentioned in the previous sentence, so there must be no new tenant protection legislation that came from this past session. In his statement Senator Rivera states that he was deeply disappointed in the end result of this legislative session. Senator Rivera says that hardworking New Yorkers were used as political pawns, the failure to make significant changes in the rent regulation laws will result in the loss of almost 90,000 current rent regulated units, there was little effort to fix the broken 421A program, Charter and private schools have made out much better than the struggling (as Senator Rivera says, but failing as many of us still say) public schools, and that no criminal justice reform legislation was passed. If you go to the bottom of the blog posting there is a statement from Assemblyman Victor Pichardo which tell of how the rent regulations deal enhances tenant protection. So who is correct on the rent regulation issue, State Senator Gustavo Rivera or Assemblyman (and former chief of staff to Senator Rivera) Victor Pichardo.

Senator Rivera also fails to make mention of the State Senate request and approval with the State Assembly of a $1.3 Million property tax rebate for homeowners outside of New York City. So why were the homeowners of the Bronx, who need this tax rebate more than the millionaires living outside of New York City, left out? Perhaps Assembly Speaker Heastie can answer that question to the struggling homeowners in his assembly district, since I know he will not answer that question if I was to ask it of him, and to Mr. Mike Whyland Press Person to Assemblyman Heastie when will I get my interview of Assemblyman Heastie? We can do it here in this newspaper if you would like you already know some of my questions, and right now the answers are 'NO COMMENT” by Assemblyman Carl Heastie. Perhaps I should ask someone like Marcia Kramer of WCBS T.V. to take this over from me, after all she did some great reporting of former State Senator Pedro Espada Jr.

The new Marriott Hotel at the Hutch Metro Center officially opened last week, and there are photos on my blog of the event. This new Marriott hotel is owned by Simone Development, and is a franchise of Marriott International. It was 

said that a short distance from the hotel (about 250 feet) that the new Metro North Morris Park station will be built in a few short years, and that travel from this new Marriott Hotel to midtown Manhattan will take less than 30 minutes. It was said that the hotel is currently operating at near capacity since its unofficial opening on Mother’s Day.

Lastly, no one with any ties to Community Board 8 had anything to do with the decision of the Kingsbridge National Ice Center at the Kingsbridge Armory located just outside of Community Board 8 in the Kingsbridge Heights section of the Bronx. It seems odd to this columnist that Councilman Fernando Cabrera has chosen as his representatives to the KNIC Community Advisory Council three people from the Riverdale area of Community Board 8, including the former Vice-Chair of CB 8 Maria Khurry who lives in Riverdale. One would have to question that since Councilman Cabrera has chosen three people from CB 8 including its former Vice-Chair, why then did Councilman Cabrera not insist that Community Board 8 be a part of the KNIC process. It kind of makes you wonder what the priorities of Councilman Cabrera are. The Kingsbridge Armory lies entirely in Community Board 7, and Community Board 7 was the only community board involved in the KNIC process. Why now are people living in Community Board 8 being brought into the process, and why not current CB 8 members?

BRONX, NEW YORK, JULY 2- Smile geniuses. A pair of criminal masterminds were caught on tape stealing an ATM machine from a fast food restaurant.

At around 10:20 a.m. on June 30, two crooks broke into the Checkers Restaurant off the Grand Concourse. The restaurant's surveillance cameras recorded the masterminds as they rocked the ATM off its attachment to the floor. They then dragged it onto a waiting hand truck and wheeled it out the door.

The masters of disguise thought wearing a bucket cap and baseball cap would hide their identity. However, the crooks' faces can clearly be seen on the video.

Gunman convicted in holiday killing

Danced over victim as he lay dying

BRONX, NEW YORK, JULY 1- District Attorney Robert Johnson announced the jury conviction of 32-year-old Cadman Williams in the Memorial Day weekend 2008 killing of a Yonkers man.

After a six-week-long trial and two hours of deliberation, the Bronx Supreme Court jury found Williams guilty of: manslaughter in the first degree (Class B Felony) and criminal possession of a weapon in the second degree (Class C Felony). 

When he is sentenced by Justice Dominic R. Massaro on July 23^rd, Williams faces as many as 40 years in prison.

Kenneth Sackey of Yonkers was celebrating not only a new job, but the long, hot, holiday weekend, returning from a family barbecue the evening before Memorial Day to his brother’s apartment in the Bronx. But as they returned to 1749 Grand Concourse, Sackey was loaded for bear, with an attitude and a bat – and when he saw some of the kids with whom he had a spat the night before, he was going to show who was boss. The 42-year-old Kenneth took his bat, and with a backhanded swing, cracked it against the entryway of the building, shattering the wood and sending splinters flying out across the sidewalk.

Williams was friendly with the kids, but he had not been at the deli with them the day before. He was not bruised by the bat, but his ego took a hit. So he hit back, drawing out his .22 caliber revolver, and squeezed off three-to-four shots – two of which hit their mark. Kenneth Sackey tried to flee through the apartment house, but video showed him falling and writhing in pain during his last minutes of life. Either bullet alone would have killed Sackey, as the one in his back struck a major vein that leads back to the heart. The bullet to the victim’s face traveled 

through to his spine.

Another surveillance video showed Williams moments after he walked past his dying victim, dancing a heartless jig as he took the elevator up to his then-girlfriend’s apartment.  

The case against Williams gained some notoriety for the delays bringing it to trial, resulting in an unusually long Rikers Island stay for the defendant. He will be credited for the nearly seven years he spent at Rikers awaiting trial.  

The primary delay involved defense requests that admissibility of the DNA found on the murder weapon be stayed until a Brooklyn judge rendered a decision regarding that type of DNA in an unrelated case. That decision finally came late last year.  But the issue DNA in Williams’ case became irrelevant when the defendant testified on the stand that he, indeed, had fired the fatal shots.

The case against Williams was prosecuted by Bronx Senior Trial Assistant D.A. George Suminski and A.D.A. Amy Schneider of Trial Bureau 20/50.

BRONX, NEW YORK, JULY 1- Police are trying to catch a Halloween masked hooligan who robbed a gas station outside Co-op City on Tuesday.

At around 3 a.m. on June 30, the suspect used a handgun to stick up the Sunoco gas station at 1945 Bartow Avenue just outside Co-op City. Sporting a Halloween mask and black hoodie, the suspect entered the gas station that sports giant neon signs for “Lottery,” “Beer” and “Cigars.” He waved a handgun at the clerks and demanded cash. Cops say the gunman made off with $650 in cash.

Police released surveillance video taken from inside the gas station’s convenience store. The suspect is described as 5 foot 7 and weighing 150 pounds. He was seen wearing a Halloween mask, a gray hoodie sweatshirt, grey pants and plastic gloves.

Driver sentenced for fatally striking mother of twins

Driver sentenced for fatally striking mother of twins

BRONX, NEW YORK, JUNE 29- District Attorney Robert Johnson announced that 29-year-old Agustus Jenkins of Montgomery, NY, has been sentenced to the maximum sentence of 1-1/3-to-4 years behind bars for the January 2014 death of the mother of twin toddlers, Nydja Herring, of the Bronx.

Jenkins was found guilty of Criminally Negligent Homicide, a Class E Felony, following an 11-day trial before Justice Peter Benitez, during which the jury returned their verdict on June 4^th after less than a day’s deliberation.

The 32-year-old victim was crossing the street at East Tremont and Van Nest Avenues, on the way to the store to buy milk for her twin toddlers, when she was struck by Jenkins’ speeding vehicle. He was behind the wheel but had a friend with him, along with two children aged four and 11.  Blood alcohol tests showed he was operating the vehicle above the legal limit. He was also driving on a suspended license. Ironically, Jenkins was coming back from the wake for a baby who had died from SIDS.

Not only were Nydja Herring’s twin 2-year-olds left without a mother, the victim’s own mother was scheduled to receive a kidney from her daughter. Herring’s mother is still on the organ transplant list.

Red Bulls Stop NYCFC in New York Derby at Yankee Stadium

The long awaited first New York City meeting between the New York Red Bulls and NYCFC took place on late Sunday afternoon at the pitch at Yankee Stadium.

Despite the pre‐match hoopla, it was not the first of the New York Derby matches in 2015. NYC visited the Red Bulls at their arena in Harrison, New Jersey on May 10. The visitors were edged 2‐1. That loss continued a lengthy NYCFC winless streak, which did not end until June 6 with a 3‐1 win over the Philadelphia Union.

In a non‐league match on June 17, NYC traveled to Shuart Stadium on the campus of Hofstra University, where they bowed to the Cosmos after two tied overtime periods in the fourth round of the U.S. Open Cup.

Those previous matches did not lower the intensity of interest in Sunday’s match as Yankee Stadium was sold out with a huge crowd of 48,047. Both coaches spoke of the importance of the importance of the very large attendance. 

Jessie Marsch of the Red Bulls complimented his club’s followers, “We couldn’t have asked for more. They were fantastic.” After the contest, NYC’s Jason Kreis said of his club’s performance, “It was an opportunity lost to win over the fans.”

NYC, familiar with the nuances of their home pitch, took an early lead with a goal in the sixth minute as Thomas McNamara scored with assists by Andrew Jacobson and Mix Diskerud. That goal would be the last from the home side as the momentum of the match changed.

Another goal was not scored by either side in the first half, but both coaches noted a change. Marsch remarked, “It [match] probably settled down in the 25th minute. Then we started to push...We thought we had a size advantage and took advantage of it.” Kreis agreed, ‘I think the second half was a continuation of the end of the first half.”

The Red Bull duo that combined for the winning goal in the match on May 10 did so again on Sunday in the second minute of the second half. Bradley Wright‐ Phillips scored on an assist by Sacha Kljestan.

The visitors went ahead five minutes later as Chris Duvall scored. In the 72nd minute, the Red Bulls scored a season high third goal as Matt Miazga was set up by Kljestan. Miazga, who came up through the Red Bulls Academy, was very happy with his goal, “I wanted to contribute. Luckily, I was able to.”

Krteis was unusually critical of his club’s play, “it was the first time we didn’t get an honest effort from all our players. We scored too early.” He believed the early goal created an attitude of “complacency and comfort” in his team.

He also named as reasons for the loss, the early removal of injured defender Chris Wingert and fatigue caused by the heat and humidity.

The exciting New York rivalries have not yet ended this year. The red Bulls will be hosting the Cosmos in a U.S. Open Cup match on Wednesday. Marsch alluded to it in the post‐game press conference, “We will enjoy the win and think about how we can transition to Wednesday. We’re not taking that game lightly.” NYCFC will visit the Red Bulls in Harrison for a final regular season match in August.

BRONX, NEW YORK, JUNE 29- Residents and visitors of Norwood got a shock recently when one popular restaurant began charging a $3 fee to use the restroom.

Those entering the El Caribe Restaurant located at 2 East Gun Hill Road were immediately confronted with a pair of signs that read, "Bathroom is only for the customers. You want to use it? You will have to pay $3.00."

One local resident who declined to use his name because he had friends among the staff, stated, "I think they’re going to lose a lot of business because it's a public facility and now your going to ban people from using the bathroom."

The resident added, "C

ustomers may want to go in there and wash their hands before a meal. Now they’re going to charge you to use the bathroom and wash your hands? That's crazy."

One East Gun Hill Road street peddler offered, "Since they started doing that we walk around the block and use the bathroom at North Central Bronx Hospital, so we just won't patronize them anymore. It's a shame and it's a lousy policy. No other restaurant is doing that, so we'll just go somewhere else."

Asked if he'd ever used the bathroom, the peddler replied, "Yes, it's a nice bathroom, but it's kind of small. It's not like the gas stations, but I don't think it's worth three bucks."

Repeated attempts for comment were met with employees slamming down the receiver of the telephone on two separate occasions.

The trend appears to be growing as the front door to the Mosholu-Montefiore Community Center a block away, now has a sign on it's from door that reads, "Sorry no public restrooms."

Pols Hail Supremes on #GayMarriage Decision 

BRONX, NEW YORK, JUNE 26- Officials throughout the Bronx hailed the Supreme Court’s decision making gay marriage the law of the land.

The court’s 5-4 decision allows gay and lesbian couples the right to marry in any of the 50 states. 

“Today is a historic day in the United States,” said Bronx Borough President Ruben Diaz Jr. “The Supreme Court has made history and affirmed a basic human right today by allowing men and women to legally marry throughout this nation, regardless of their sexual orientation.

“After two decades of litigation, the Supreme Court has finally expanded equal rights and marriage equality to all. I would like to thank the Supreme Court for having the courage to make this bold decision, and I congratulate this nation’s LGBT community for their efforts on this issue,” Diaz said.

“Today the Supreme Court put to rest a decades-long civil rights struggle for marriage equality,” said Rep. Joe Crowley. “In its decision the Supreme Court affirmed what a majority of Americans believe, that marriage between two loving individuals, regardless of their sex, deserves full protection under the law as afforded under the 14^th Amendment. History will remember this day as a watershed moment, a day when ‘we the people’ took another major step toward justice in our enormous and enduring struggle to form a more perfect union.

“So today, as we celebrate this momentous victory for our gay, lesbian, bisexual and transgender brothers and sisters let us also remember those we lost along the way. Those who came before us as activists, advocates, and allies who, when faced with bigotry and violence, did not shrink, but rather stood for the belief that discrimination based on sexual orientation has absolutely no place in the laws and policies of our country. We stand on the shoulders of those giants today, and proudly proclaim love is love.”

“America will never forget this day, and neither will people all across the world who know the meaning of love and compassion,” said Mayor Bill deBlasio “June 26, 2015, will forever be memorialized as a pivotal moment in the history of our nation – the day the Supreme Court affirmed our core values of love, equality, and justice, rejected ignorance and malice, and appealed to the humanity in us all. Our country will finally afford millions of Americans the rights they have always deserved, but until now were unable to exercise. Today, this country is richer – filled with 

more equality, more acceptance, and more love than yesterday. And for the people of this city, where the movement for LGBT rights began in 1969 at the Stonewall Inn, we can be proud that we helped blaze the trail to this great victory.”

Congressman Charles B. Rangel, who represents the 13th Congressional District of New York that includes Upper Manhattan and parts of the Bronx, released the following statement on the Unite States Supreme decision on same-sex marriage:

"Indeed, all love is equal. I applaud the Supreme Court ruling on the same-sex marriage case and reaffirming that the union of the LGBT community should be treated equally. This decision marks another milestone toward American progress as the court reaffirms equal protections guaranteed to all Americans under the 14th Amendment. Today, a long overdue justice and equality have been served.

“Far too many couples have been denied protections by their governments, rights to legally commit to one another, and basic responsibilities as spouse and parents. The Court's ruling today makes it loud and clear that same-sex marriage is less about redefining the institution of marriage, but more so to ensure fundamental rights and dignity that gays and lesbians across the country deserve.

“As our nation celebrates Pride Month, this ruling could not come at a more appropriate time. I am proud that New York State is a leader in marriage equality and I look forward to other states across the nation recognizing this important right for all people. Let us continue on our path towards progress and let nothing stand in the way of ensuring equality for all,” Rangel said.

Nova Return on Mound Gave Yankees boost they Needed

Ivan Nova had a sleepless Tuesday night knowing in a few hours he would be making his season debut Wednesday afternoon at Yankee Stadium. The New York Yankees right-hander was anxious to get the ball again after a 14-month recovery and rehab stint from Tommy John surgery to repair the ulnar collateral ligament in his right elbow.

The wait was over and Nova was a boost the Yankees needed. More so, because the Yankees top three in the rotation of Masahiro Tanaka, Michael Pineda and CC Sabathia had three consecutive bad starts, Nova had to be a stopper and he was as New York took the finale of a three game series with a 10-2 win over the lowly Philadelphia Phillies.

And it was important for Nova to prove that his comeback was complete. Just as important was the Yankees getting a win and preventing the Phillies from getting a three-game sweep in the Bronx. 

“Sinker was really  good and the curve,” said Yankees manager Joe Girardi about Nova. The manager said everything was good and that included the command and how Nova kept his pace.  It was Nova’s first Major League appearance since April 19th of last year at Tampa Bay, and the final numbers showed he was ready:

He retired eight of the first nine batters faced, 19 of his first 22, tossed 6.2 innings, allowed three hits, two walks, had one strikeout and allowed no-runs. 

The last number, no runs was a change of pace because over the past three games the Yankees starters and bullpen allowed 34 runs to the Phillies, a team that scores the second fewest runs in baseball. There was no doubt that Nova is what the Yankees needed as they embarked on their two city road trip, with four games at Houston and three against the Los Angeles Angels.

Girardi never had his doubts about Nova. “He’s pitched well in our rotation the last few years,” he said. “We missed him the last 14-months.” 

And Nova is what the Yankees need now, especially when it appears that Sabathia is no longer pitching like an ace, there are questions about a Tanaka elbow and then there is the inconsistency of Pineda. 

Until what Nova did on the mound Wednesday afternoon. the lone reliable Yankees starter has been Adam Warren who got a win over the Detroit Tigers last Friday night, and it will probably mean he returns to the bullpen unless Girardi decides to go with a six-man rotation.  

The command from Nova was nice to see, and the talk was how hard the 28-year old worked hard to get back.

“It was more than expected,” Nova said about his return performance in the Bronx. He was asked if this was more special than his debut with the Yankees, and his first start in 2010.

“This was more,” he said, “Because I worked through rehab.” It was 14-months and constantly working with the rehab process down in Tampa Florida, but starting a season on the sidelines and anxious to get back made the process easier for Nova, who according to Girardi has always been instrumental in the Yankees pitching rotation.

Said Nova, who was thrilled to be back and contributing to his team,”I think that’s one of the best things, not only to come back, but to do it in front of the Yankees fans. It’s amazing the way they treated me today, so I’m really happy.”  When his day was over after throwing 92 pitches, the 45,877 in the matinee crowd gave Nova a standing ovation and he responded by tipping his cap. It was a happy return and the outing Nova, the Yankees and their fans needed. Girardi had said the pitch limit for this first start would be no more than 95 pitches.

Nova added, “ When I was walking to the mound, I didn’t believe it had been 14 months.  I was able to keep calm and try to do my best out there. Think positive the whole time. I was ready to go.”

But five days ago, in a final rehab start at Triple -A Scranton, Nova was ineffective and the curve ball, this according to a longtime scout, was not breaking as he allowed five earned runs, and seven hits in seven innings. There was discussion of possibly moving back his return and having one or two more rehab stints at Scranton. 

The schedule is favorable for Nova to be here now and contribute, and Girardi commented that works in his favor to build up more. 

“Thing is, he is healthy and sound,” Girardi said.  “He’s not thrown a lot of innings this year  so its not like you’re asking him to throw 200 innings.”  And the ability to throw strikes and get fly ball outs showed that the command was there.

And there was that pace that Nova had, something that impressed Girardi and his teammates who were more than happy to see him back on the mound.

“Not a whole lot works him up but given the circumstances and the year off he had, it would be easy to be a little too aggressive out there,” said John Ryan Murphy the catcher who saw the calm and comfort Nova had behind the plate.

“Early in the game,” Murphy said, “we just wanted to get rolling and get him some outs under his belt and we did that. He got comfortable there and kept his nerves calm and did a great job.”

And for the Yankees it was what they needed as they gained a game on Tampa Bay in the tight AL East race for first place in late June.
